What is sexual harassment?

Sexual harassment refers to acts that not only violate an individual’s right to sexual autonomy but also cause sexual discrimination pertaining to work and education-related rights via unwanted sexual words and actions in the workplace, a public body, at school, or another group.

Preventive Guidelines for Sexual Harassment and Sexual Assault – Article 2, Clause 1

‘Sexual harassment‘ refers to acts that fall under any of the following categories relating to work, hiring, or other relationships.

  • 01.Acts that cause the other party to feel sexual humiliation or aversion as a result of sexual comments, behaviors, or requests relating to work or by utilizing one‘s status.
  • 02.Acts involving putting someone at a disadvantage due to their refusal to comply with sexual comments, behaviors, or requests, or providing or declaring an intent to provide benefits based around compliance with sexual comments, behaviors, or requests.
  • 03.Acts that enlarge the damage of sexual harassment by sympathizing or aligning themselves with sexual harassment.
What is sexual assault?

Sexual assault (sexual violence) refers to al sexual speech and behavior that goes against the intention of the other party and amounts to mental, verbal, or physical violence that violates an individual’s right to sexual autonomy.

Preventive Guidelines for Sexual Harassment and Sexual Assault – Article 2, Clause 2

‘Sexual assault‘ refers to all physical/verbal/mental violence that violates an individual’s right to free sexual discretion and personal rights, especially referring to cases that fall under the category of misdeeds as regulated in Article 2, Clause 1 of Special Laws Pertaining to Punishment for Sexual Assault Crimes.
